Terms and Conditions
Last updated
These terms apply when you buy or sell foreign currency banknotes at our Auburn store, and when you use this website.
In short
A plain-English summary for convenience. The full text below is what applies.
- We are a walk-in currency exchange. We buy and sell foreign cash over the counter - we do not offer money transfers or online ordering.
- We charge 0% commission. Our revenue comes from the margin between our buy and sell rates.
- Rates on this site are timestamped and move during the day. The rate that applies is the one confirmed at the counter when you exchange.
- Australian law requires us to verify identity, so please bring valid ID. Nothing here limits your rights under the Australian Consumer Law.
1. Agreement overview
These Terms and Conditions set out the agreement between you and TMEX PTY LTD (ABN 93 684 277 745, ACN 684 277 745), trading as TMEX Currency Exchange - "TMEX", "we", "us" or "our" - covering the use of our services and this website.
By using our services or this website, you accept and agree to comply with these terms. If you do not agree, please do not use our services.
2. Definitions
- "You", "your" - the customer using our services, or a visitor to this website.
- "Services" - the buying and selling of foreign currency banknotes over the counter at our store.
- "Transaction" - a single exchange of one currency for another at our counter.
- "Rate" - the exchange rate applied to a transaction, confirmed at the counter at the time of the exchange.
- "Verify" - the process of confirming your identity, as required by Australian law.
- "Store" - our premises at 21 Auburn Road, Auburn NSW 2144.
- "Website" - our online platform at tmexchange.com.au.
3. Our services
TMEX buys and sells foreign currency banknotes in person at our Auburn store. Our service is a cash exchange completed at the counter.
We do not provide money transfer or remittance services, we do not hold funds on your behalf, and we do not operate customer accounts or an online ordering system. You may call us to reserve currency for collection, but the transaction itself is completed in person.
4. Who can transact with us
To exchange currency with us you must:
- be at least 18 years old;
- provide valid identification where required (see section 8);
- provide accurate information when we are required to record it.
TMEX may decline any transaction at its discretion, including where identification requirements are not met.
5. Rates, fees and payment
We charge 0% commission on the currencies we hold. Our revenue comes from the margin between our buy and sell rates, which varies by currency and over time.
Rates shown on this website are published with a timestamp and update through the day. The rate that applies to your transaction is the rate confirmed at the counter at the time of the exchange, not the rate displayed earlier on the website.
Payment is due in full at the time of the transaction. Your bank or card provider may apply its own charges, which are outside our control.
6. How an exchange works
A transaction is completed at the counter in the following way:
- we confirm the currency, the amount and the current rate with you;
- we verify your identity where required;
- you pay, and we hand over the counted currency;
- we provide a receipt for the transaction.
Please count and check your currency before leaving the counter. Availability of particular currencies and denominations can vary; for larger amounts we recommend calling ahead.
7. Cancellations and refunds
Because an exchange is completed and settled at the counter, it cannot be cancelled once finished. If you wish to reverse an exchange afterwards, that is treated as a new transaction at the rates applying at that time, which may differ from your original rate.
If we have made an error in a transaction, contact us as soon as possible with your receipt and we will correct it.
Nothing in these terms limits your rights under the Australian Consumer Law.
8. Compliance and identity verification
As required by Australian anti-money-laundering and counter-terrorism-financing law, TMEX verifies customer identities and reports certain transactions.
You may be asked to provide identification documents such as a passport or driver licence, and we may use government and private databases for verification. We may decline or delay a transaction where these requirements are not met.
9. Privacy
TMEX handles personal information in compliance with the Privacy Act 1988 (Cth). By using our services you consent to the collection and use of your data for transaction processing, fraud prevention and legal compliance. We may disclose information to authorities where required by law.
Full detail is in our Privacy Policy.
10. Limitation of liability
To the extent permitted by law, TMEX's liability arising from a transaction is limited to AUD 100.00 plus a refund of the transaction amount and any applicable fees.
We are not responsible for losses caused by:
- system failures, natural disasters or legal restrictions;
- incorrect details provided by a customer;
- circumstances beyond our reasonable control.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
11. Intellectual property
All content on the TMEX website, including text, graphics and databases, is owned by TMEX. You may not reproduce, distribute or modify any website content without prior written permission.
12. Complaints and dispute resolution
If you have a complaint, contact us at accounts@tmexchange.com.au or call 02 9643 9224. We will acknowledge your complaint within five business days and aim to resolve it within five weeks.
If you remain dissatisfied, you may escalate your complaint to the Australian Financial Complaints Authority (AFCA), the external dispute resolution scheme that replaced the Financial Ombudsman Service.
13. Changes to these terms
We may update these terms periodically. The current version is always published on this page, with the last updated date shown at the top. Continued use of our services after a change constitutes acceptance of the updated terms.
14. No financial advice
Our services do not constitute investment or financial advice. Exchange rates move, and we do not advise on whether or when you should exchange currency. You are responsible for your own decisions and should seek professional advice if needed.
15. Disclaimer
We do not guarantee uninterrupted access to this website and are not liable for errors, delays or disruptions beyond our control. Rates and other information published on the website are provided in good faith and are confirmed at the counter before any transaction is completed.
16. Governing law
These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes arising from this agreement will be resolved in the courts of New South Wales.
17. Agreement acknowledgment
By using TMEX services you confirm that you have read, understood and agreed to these Terms and Conditions. If you do not accept any part of this agreement, please discontinue using our services.
